El treballador rep una carta d’acomiadament, despr\u00e9s de tres anys i mitj\u00e0 formant part de l’empresa, en qu\u00e8 li comuniquen l’acomiadament disciplinari. S’argumenten una s\u00e8rie de conductes que conformen una falta molt greu, per\u00f2 que el treballador nega que hagin succe\u00eft.<\/p>\n

Davant la falta de conciliaci\u00f3 en el CMAC es formula demanda en el jutjat del Social i el dia del judici l’empresa s’av\u00e9 que cal pagar la indemnitzaci\u00f3 que li hav\u00edem requerit per acomiadament improcedent.<\/p>\n

En aquest cas, una empresa que va perdent negoci gradualment es veu obligada a acomiadar a un treballador de la plantilla. Els volums de facturaci\u00f3 indiquen aquesta clara disminuci\u00f3 durant els tres anys anteriors, per la qual cosa, d’acord amb l’Estatut dels Treballadors, l’empresa notifica un acomiadament objectiu. El treballador s’oposa amb base en qu\u00e8 l’empresa forma part d’un grup ampli amb unes altres societats i demana ser recol\u00b7locat, per\u00f2 ni el tipus de treball ni la zona geogr\u00e0fica el permeten. Aix\u00ed, arribat el judici, es confirma per sent\u00e8ncia la proced\u00e8ncia de l’acomiadament.<\/p>\n

Un cas de mala pr\u00e0ctica per part d’un empresari. En primer lloc, acomiadament a la treballadora amb arguments improcedents, per la qual cosa presentem papereta de conciliaci\u00f3 en el CMAC. La treballadora estava de baixa m\u00e8dica una vegada readmesa, i l’empresa decideix no pagar-li el salari en pagament delegat, com era la seva obligaci\u00f3, causant greus problemes econ\u00f2mics a la treballadora, que es veu en la necessitat d’acudir a la Seguretat Social a sol\u00b7licitar el pagament directe.
